Terms and conditions for using Lodge Easy PMS software for Italian hospitality properties. SaaS platform access and usage agreement.

1. Acceptance of Terms
Access to and use of the Lodge Easy platform (the "Service") is subject to these Terms and Conditions. By using the Service, the User acknowledges that they have read, understood, and agreed to all terms. If you do not agree, do not use the Service. Lodge Easy S.r.l., registered office at Via Cipro 1 5 Piano INT. 250/A - Brescia (BS), VAT IT04723920981, reserves the right to modify these terms at any time, communicating changes with 30 days' notice.
2. Service Description
Lodge Easy is a Property Management System (PMS) provided as Software as a Service (SaaS), specifically designed for Italian hospitality properties. The Service includes: booking management, automatic integration with ISTAT and Questura (Alloggiati Web), electronic invoicing (SDI), payment processing through integrated gateways (Stripe, Nexi, RoxPay), channel manager, booking engine, housekeeping app, reports and analytics, and AI features. Lodge Easy commits to maintaining Service availability of at least 99.5% (excluding scheduled maintenance communicated 48 hours in advance).
3. Registration and Account
To use the Service, the User must register by providing truthful, accurate, and complete information. The User is responsible for maintaining the confidentiality of their login credentials and for all activities under their account. Lodge Easy shall not be liable for any loss or damage arising from unauthorized access due to User negligence in protecting credentials. The User agrees to immediately notify Lodge Easy of any unauthorized use of their account.
4. User Obligations
The User agrees to: (a) use the Service in compliance with applicable laws and regulations, including GDPR (Reg. EU 2016/679); (b) not use the Service for illegal or unauthorized purposes; (c) not attempt to access parts of the Service not intended for the User; (d) not interfere with the proper functioning of the Service; (e) not copy, modify, distribute, or create derivative works based on the Service; (f) ensure that all data entered into the system (including guest data, identification documents, and tax information) is accurate and compliant with data protection regulations.
5. Privacy and Personal Data
The processing of personal data is governed by our Privacy Policy, available at /privacy. Lodge Easy acts as Data Controller for data collected during website navigation and as Data Processor for guest data entered by the User in the PMS. Lodge Easy implements appropriate technical and organizational security measures to protect personal data, including TLS 1.3 encryption, daily backups, two-factor authentication, and GDPR-compliant EU data centers. Guest data is retained for the contract duration and deleted within 90 days of termination, subject to legal obligations.
6. Payment Terms and Billing
Service fees are published on the /pricing page and are based on the number of managed rooms. Payments are monthly or annual as agreed upon subscription. Invoices are electronically issued via SDI and sent to the User's email address. Non-payment within 15 days of the due date results in Service suspension. In case of early termination, paid fees will not be refunded unless otherwise agreed in writing. All prices are exclusive of VAT. Lodge Easy reserves the right to modify pricing with 60 days' notice.
7. Support and Assistance
Lodge Easy provides technical support via email (support@lodgeasy.app), integrated chat, and phone during business hours (Mon-Fri, 9:00-18:00 CET). Guaranteed response times are: urgent requests within 4 hours, standard requests within 24 hours. Initial training and onboarding are included in all plans. Support is available in Italian and English.
8. Intellectual Property
Lodge Easy S.r.l. holds all intellectual property rights related to the platform, including software, design, logo, brand, content, and documentation. The User receives a non-exclusive, non-transferable, revocable license to use the Service during the subscription term. The User retains ownership of their data and content entered into the platform. Decompiling, disassembling, or reverse engineering of Lodge Easy software is prohibited.
9. Limitation of Liability
Lodge Easy provides the Service "as is" and "as available" with professional diligence. In no event shall Lodge Easy be liable for indirect, incidental, special, or consequential damages arising from Service use. Lodge Easy's total liability for any claim relating to the Service is limited to the total fees paid by the User in the 12 months preceding the claim. Lodge Easy is not liable for: (a) service interruptions due to scheduled maintenance; (b) technical issues beyond our reasonable control; (c) inaccuracy of data entered by the User; (d) User's failure to comply with regulatory obligations.
10. Term and Termination
The contract has a minimum term of 12 months from activation date. Thereafter, it automatically renews month-to-month unless terminated with at least 30 days' notice. Lodge Easy may suspend or terminate the Service with 30 days' notice in case of material breach of these terms or non-payment. Upon termination, the User may export their data within 30 days. After this period, Lodge Easy will permanently delete all User data.
11. Regulatory Compliance
Lodge Easy guarantees Service compliance with: General Data Protection Regulation (GDPR EU 2016/679), Italian electronic invoicing regulations (SDI and tax receipts), ISTAT and Questura (Alloggiati Web) reporting obligations, PCI-DSS Level 1 standards for credit card payments, and applicable e-commerce regulations (Italian Legislative Decree 70/2003). It is the User's responsibility to verify that the Service meets their specific regulatory requirements.
12. Governing Law and Jurisdiction
These terms are governed by Italian law. For any dispute relating to the Service, the competent court is Brescia, Italy. Lodge Easy and the User will attempt to resolve any dispute amicably before resorting to judicial authority.
